In Pennsylvania, the law grants grandparents the right, under certain circumstances, to petition for custody rights with respect to their grandchildren. Grandparents may seek custody rights if they have a pre-existing relationship with their grandchild and there are allegations of abuse, neglect, or dependency, or if the grandparent’s child (the parent of the child for whom the grandparent seeks custody) has died. A court may decline to grant grandparents custody if both parents object to custody as not in their child’s best interests. In addition to grandparents, other family members may have standing to seek custody if they have been acting as a parent for the child for at least 12 months, under a legal doctrine known as in loco parentis.
Not necessarily. Parents have a constitutional right to parent their children in whatever way they see fit that does not endanger the health or welfare of the child. A court does not have to intervene if parents agree that a particular custody arrangement is best for their family. However, there are benefits to having a court enter an order memorializing a child custody arrangement. Even when parents initially agree upon a custody arrangement, if one parent stops honoring that agreement, it will be much easier for the other parent to enforce the arrangement if it is a court order.
