Every person needs an estate plan that covers several core components, regardless of assets or whether you have dependents.  Those include:

  • Your Will, which includes instructions about asset division after death, who will be put in charge of carrying out your wishes, and can also specify who will gain custody of your minor children,
  • A trust, which can be revocable or irrevocable,
  • A financial power of attorney to provide authority to a trusted individual or fiduciary to handle your financial affairs should you become unable to do so, and
  • An advance healthcare directive to ensure that your wishes regarding medical care are known if you become unable to do so yourself.

Aside from those core documents, there is no one-size-fits all approach to determining your estate planning and administration needs.  Our experienced Souderton estate planning and administration lawyers will sit down with you and discuss your individual circumstances and goals.  By getting to know you and your family, we will create a plan that is right for you.

Frequently Asked Questions About Estate Planning & Administration Issues

FAQ: What assets will have to go through the probate process in Souderton?

The probate process in Pennsylvania can create complications that are better to avoid. Generally, only assets that you own alone—only in your name—will go through probate. Excluded assets include:

-Retirement assets and accounts where you specify a beneficiary avoid probate,
-Assets (including your home) that you own jointly with a spouse or someone else,
-Relatively small amounts of money (up to $10,000) can be released from bank accounts to cover funeral costs,
-Assets held in your trust, even if that trust is revocable so that you retain control over the assets.

FAQ: Will my heirs have to pay taxes on my estate?

Pennsylvania’s inheritance tax applies if someone other than a surviving spouse or charity inherits your assets. The amount of the tax depends upon how your heirs are related to you (the more closely related, the lower the tax rate—the rate for children who inherit is 4.5%). The federal estate tax exemption is currently more than $11.5 million per person ($11.58 million in 2020). However, that high exemption rate is set to expire in a few years—and federal estate tax rules are constantly in flux. Our lawyers can help you develop a flexible estate plan to maximize the current exemption while accounting for future changes.
